Good Morning Everyone:
In anticipation of our return to the office on January 3, 2022, Stark & Stark will be requiring all employees who work in the office to provide proof of vaccination or to test on a weekly basis. VitalCheck will be administering this program. Below, you will find the program details.
VitalCheck will be conducting a survey of each employee asking if they are vaccinated or not. The survey will be sent today via personal text message and personal email, similar to your daily certification messages. The survey results will be treated as confidential and only shared on a need-to-know basis and as permitted under applicable law.
ALL EMPLOYEES MUST complete the VitalCheck survey no later than December 15th.
Individuals who indicate they are vaccinated will be required to upload proof of their vaccine record directly to VitalCheck within the survey link. The FAQ (linked below) provides a list of acceptable forms of proof of vaccination. Please do not provide any other medical or genetic information outside of your COVID-19 vaccination status when providing proof of vaccination in response to the survey. If you have difficulty with your personal uploads, please click on the chat support option within the survey.
Employees who disclose that they are not fully-vaccinated (see CDC guidance on vaccine status), or do not provide the required proof of vaccination by December 15th, will receive an invitation from VitalCheck to schedule weekly testing, which must be completed every Wednesday, beginning on December 29th. Testing kits will be mailed to you by VitalCheck and must be utilized for this testing.
Please see the Frequently Asked Questions Document for additional details (click here for FAQ). The Firm will also be providing a more detailed policy regarding these vaccinations and testing requirements and other return to work plans in the upcoming weeks.

The Firm plans to begin its Phase II Return to the Office (Phase II) on Monday, July 12, 2021. Below, we have outlined a timeline for your review.
VitalCheck
June 7
Beginning June 7, if you haven’t already been checking in daily with VitalCheck, you will need to start your daily check-ins. Human Resources will be reaching out to you to schedule your first VitalCheck appointment. It is critically important that you read the daily questionnaire from VitalCheck and that you answer all of VitalCheck’s questions thoughtfully and truthfully.
Travel Policy Lifted
June 7
Also, beginning June 7, the Firm will lift all restrictions regarding travel. VitalCheck will become the primary screening tool for clearing employees to come into the office.
Town Hall Meetings and Rollout of Phase II Schedule
June 14 and June 17
We will be conducting virtual Town Hall meetings on June 14 at 12:00 p.m. and June 17 at 10:00 a.m. Each of these meetings will cover identical material, and they will be structured to review the details of Phase II. In addition to our Town Hall meetings, we will be sending out a detailed Phase II plan document and everyone’s A/B groupings and schedules during the week of June 14. No signup is required for these meetings, and we will be sending Outlook/Zoom invitations to everyone for both meetings.
Reorientation & Orientation
June 21 - July 9
For those of you who have NOT been to the office since last March, you must attend a MANDATORY in-person meeting with IT between June 21 and July 9. We need to ensure that your equipment is working correctly, and we’d like you to have some time to organize your work area in preparation for your return on July 12 or July 19. A SignUpGenius will be sent to you in the coming days.
In addition to reorientation, everyone who was hired after March 2020 will be contacted by Human Resources for an orientation day.
Phase II - A/B In Office
July 12 - September 3
Starting on July 12, we will begin the Firm’s A/B schedule, and we expect everyone to work in the office during their scheduled weeks. Additionally, our office hours will change back to their regular hours before the pandemic crisis. If you have concerns about your schedule, please reach out to Human Resources.
Through Labor Day, we will continue requiring masks in all common areas of our offices. You can remove your mask while you are at your desk and at least 6 feet away from others. Additionally, the Firm will remain closed to guests, except the 2nd Floor in Lawrenceville, which must be pre-scheduled with Human Resources.
Anticipated Full Return
September 7
We are very hopeful that everyone will be returning to the office on Tuesday, September 7. If anything changes, we will communicate accordingly.

Good Morning Everyone.
We hope that you and your families are well. As Spring begins, we continue our planning for our phased return to the office. We would like to share with you (1) the Firm’s expectations regarding our current return to the office plan (Phase I RTO Plan) and (2) how we expect to begin discussions for a safe and orderly return to the office for everyone.
Our Phase I RTO Plan remains in effect, and you should continue to maintain your current schedule. Phase I will continue through May 31, 2021, at the earliest. We have outlined minor changes to the Phase I RTO Plan below.
In April, we will be inviting everyone to attend small virtual group discussions to review and seek feedback from you on our eventual full return to the office.
Changes & Reminders Regarding Phase I RTO Plan
In All Offices
In “Additional Hours” on page 5 of the RTO Plan, the number of individuals permitted to be in the office for each group has been increased from two (2) to five (5) per week, but at most once per day, according to the group’s assigned schedule.
Travel
According to CDC guidelines, the Firm has modified its pandemic travel policy. Upon returning from travel to any “Area of High Risk or Quarantine Area,” you must stay home and self-quarantine for either seven or ten days, depending upon whether you are COVID tested and test negative. Please refer to “Travel” on page 11 of the RTO Plan for more information.

Ladies and Gentlemen,
I hope that this message finds you safe and well. As we approach October 31, we recognize that the guidance from public officials has not changed, and many of our schools remain in a remote schooling posture. As a result, we plan to continue our Phase I RTO through at least January 31, 2021. Over the past few weeks we have heard from many of you that having more access to the office would be helpful, so we will be introducing a few minor changes, which are outlined below together with a few reminders:
- For your review, please see the Firm’s revised Phase I RTO Plan. It is the Firm’s governing document for managing the pandemic situation.
- The schedule for our current on-site staff will not change. In other words, if you are currently working in the office, you should continue doing so.
- Our hours in our offices will continue to be 7:30 a.m. to 3:30 p.m. for on-site staff, with the doors opening for attorneys at 4 p.m. Saturdays, Sundays, and office holidays will be open all day to attorneys.
- Beginning November 2, 2020, individual team leaders will be given the flexibility to permit a limited number of individuals (including attorneys) to work in the office during the hours of 7:30 to 3:30. Hopefully, this will allow each of your teams some flexibility to continue to serve our clients at the highest level.
- The number of individuals mentioned above is highly limited: In addition to current on-site staff, each team will be permitted to allow at most one person onsite during any given workday. Team leaders will communicate with you more about the opportunities to come onsite.
- If you work in an office, you must keep your door closed at all times while you are in it.
- Now that we all have laptops, if you are coming into the office, do not forget to bring your laptop to work and to bring it back home again. IT will not be able to provide you with a loaner if you forget it.
It is important to note that we will be limiting attendance in our offices to no more than 20% of the available seating. In each of our offices maximum regular attendance is limited as follows:
- Lawrenceville: 50 people
- Marlton: 6 people
- Yardley: 6 people
20% gives us a small buffer before we reach 25% attendance, which is the maximum attendance Management will currently permit in the office. If an individual is not scheduled to be in the office, but an emergent situation arises, you will need to get approval from Michael to be in any of our offices.
Finally, our Human Resources and Marketing teams have prepared the following RTO educational video for your viewing pleasure, and Michael and I will be hosting a Town Hall to answer any of your questions on Wednesday, October 28 at 9:30 a.m. on Zoom. You do not need to register for this event. Just click the link to join.
As always, our primary concern is the health of you and your family. If you have family-care or health-care issues that make it difficult or impossible to work in the office, we will continue to be flexible.

Yesterday’s disruption at our Lawrenceville office is a critical reminder of the need for us all to be extremely thoughtful, considerate and careful when coming to the office. Our policies and procedures are in place to protect the health and safety of our employees and their families. If they are not followed, it puts everyone at risk.
The cold and flu season is upon us. Although we may have previously come to work “with a simple cold,” our public health situation requires us to take our personal health extremely seriously to assure the health of others. No one is permitted to be in the office if they show any symptoms (unrelated to seasonal allergies) of COVID-19. As per CDC guidelines, these symptoms include the following:
- Fever or chills
- Cough
- Shortness of breath or difficulty breathing
- Fatigue
- Muscle or body aches
- Headache
- New loss of taste or smell
- Sore throat
- Congestion or runny nose
- Nausea or vomiting
- Diarrhea
Those of you who are approved to work in the office receive our mandatory daily check-ins with VitalCheck. Please be sure you are monitoring your health closely each morning so you may accurately respond to the check-in. This check-in is an assertion by you that you are symptom-free and able to come into the office. You must be thoughtful and honest in responding to the daily VitalCheck text messages. By ignoring symptoms, you put your colleagues at risk, and you disrupt the Firm’s ability to serve its clients.
The safety of you and your families is our top concern. If you are not feeling well, you must stay home.

Effective immediately, attorneys will be permitted to be in the office all day on weekends (both Saturday and Sunday) and holidays. When there is a need for in-office overtime or special staff projects on the weekends, we will deal with those needs on a case by case basis.

Good morning everyone,
I hope that you and your families are safe, doing well, and enjoying the summer. As we near the end of July, I want to share the Firm’s current thoughts regarding our eventual return to the office.
First, and always first, your health and the health of your families come first. Based on our current understanding of the public health situation, we expect to continue our current Phase I through AT LEAST September 30th. We continue to monitor guidance from government and public health officials; however, we will not change our current mode of operations before September 30th, and it is very likely that Phase I will continue well beyond that date.
Please let me directly address a few concerns that we have been hearing from many of you:
- Will the Firm be flexible with me if schools do not reopen (or reopen partially), or day-care centers cannot operate safely? Absolutely. We understand that you have responsibilities to your families. We will not make any plans for a more significant return to the office until we understand what our school systems and day-care centers are doing.
- Will the Firm be flexible with me if I have a health concern or if members of my household are at risk? Absolutely. Your health, and your family’s health, are our top concern.
- I’m struggling to balance the pressure of working from home, taking care of my family, and/or meeting the needs of the Firm. Can I get some help? Of course.
- If you have a workload concern, please speak openly and honestly with your supervisor, Greg Deatz, or me, and we will work with you.
- Coping with the stress of the public health crisis, whether it is emotional, financial, or family-related, can be daunting. We have an Employee Assistance Program which is available to assist you during these times. It is confidential and free to all employees. You can reach out to them any time: 888-293-6948.

Good morning everyone,
I hope you and your families are safe and well. As we approach the holiday weekend, I know many of you are anxiously awaiting solid direction regarding a return to the office. Let me share our current thoughts with you.
Our number one consideration when evaluating how we operate is your health and the health of your families. Based upon current health information, we expect that the Firm will continue to serve our clients primarily from home through the end of June, and it is likely that this will continue well into the summer.
While we continue to work primarily from home and as we continue to learn new information from health experts and governmental authorities, we will introduce the details of a slow, gradual, and safe return to the office. The details will include the following:
- Office health and safety procedures;
- Policies to assure that everyone in our offices are symptom free;
- Limiting our onsite personnel during our daytime working hours to those necessary to perform tasks that should be performed on site;
- Continued restrictions on outside visitors to our offices; and
- Continued and improved support for all our team members working from home as we continue to serve our clients remotely.
As we develop detailed plans, please know we understand that your home lives have changed dramatically. For example, camps may not operate and child care may not be available. We understand these struggles and will continue to support you as you work through them.
We are an amazing team, and we are accomplishing something that was unthinkable before this crisis began. We are serving our clients at the highest level, even while most of us are working from home. Because of this, we are in no rush to “get back to normal,” and the driving principle behind every action we have taken and will take is everyone’s health.
Finally, Memorial Day is a time to honor the many who have served and sacrificed for our country. Please take some much needed time away from work, and remember those who have sacrificed and continue to sacrifice themselves: our soldiers, our first-responders, and our front-line workers.

Good Afternoon Everyone,
In the last week, our government officials have announced some general guidelines for returning to work. It is still not clear when or how the stay-at-home order will be lifted, but we want you to know that we have been working very hard on a plan for our eventual return to work. To be clear, we do not have a specific date that our offices will be open, we are simply planning for the future.
The driving principle behind every action we’ve taken is everyone’s health, and as our state governments relax their stay-at-home orders, our focus will still be on everyone’s health. We are currently developing plans to make our current onsite operations even more effective, so that we can be very careful and deliberate introducing people back to the office. Here are just a few of the issues we are considering:
- Social distancing and limiting face time with colleagues and clients will continue to be a priority for an extended period of time.
- Office hygiene will continue to be a top priority.
- Many of you have family-care issues at home that may impact your ability to come into the office on a regular basis. We’re going to be very thoughtful about mandating a return to the office for those with significant family-care issues.
- Some of you have challenges at home and need a quiet place to work – like the office. We are working to address that need without risking everyone’s health.
- Some of you may be in a high-risk category that may make returning to the office too early a concern. People who are in a high-risk shouldn’t be at the office right now.
We will have a fully fleshed out plan soon, and we will communicate it to you as soon as it is ready. Thank you for your patience and your hard work through this very difficult time.
I continue to be so impressed by the amazing hard work and teamwork that everyone has displayed, and I am incredibly proud to be serving you.

Good afternoon everyone,
I hope you and your families are safe and well. As the coronavirus has continued to disrupt our daily lives, Stark & Stark continues to work together and thrive.
It is very likely that our current working situation will continue well into May. While our “new normal” is beginning to feel old, it continues to feel anything but normal. Most importantly, I see every day more and more evidence of the incredible strength of our family. From Donna Fodor’s spontaneous shout out last week to the wonderful spirit I saw on Friday for our tropical shirt day, you continue to show each other our firm’s heart.
On a more somber note, the outpouring of sympathy on the news of Micky’s passing was truly moving. Although we can’t be together, you’ve proven that we continue to care for and support each other as we face difficult news and challenging times.

Good morning everyone,
I hope you are well. As each day passes and with every conversation I have, I learn more and more about how this virus is hitting closer and closer to home for all of us. Whether you, a family member, neighbor, or a friend have been diagnosed with this virus or you are simply seeing it on the news, there is no doubt that we will continue to see the effects of this in each moment of every day.
Last week, we reported that one of our employees had been diagnosed, and this week, a second diagnosis was reported to us. I am very pleased to report that both are doing very well. For those of you who are working at home, I ask you to continue to stay at home and isolate from others as much as you can. For everyone, please practice appropriate social distancing, keep your area clean, and wash your hands frequently (and then some more). I promise you we are doing everything we can to keep our offices safe for those who are part of our onsite team.

I hope you and your families are safe and well. First, there is no truth to the rumor that I walk around here with infrared detection, looking for folks working in dark corners of the office.
On to more serious matters, it is clear that the need to restrict travel and limit office activities to critical functions only will continue until at least April 30. We plan to abide by the guidance that comes from our local, state, and federal authorities, and accordingly, we plan to continue our current status quo of working remotely with a skeleton crew at our Lawrenceville and Marlton offices. Please be assured that we will continue to keep you informed and share what we know.
Based on the conversations I have had with many of you, I know how hard you are working to serve our clients and support each other. I also know how hard this has been on some of you – working from home isn’t easy. Please remember that it is OK to be pulled to help your family when you need to. If you need to step away for a bit to help your child with their on-line learning or to care for a household member, it is OK. Just keep your group in the loop, and we can be flexible with the hours that you keep.

Stark & Stark, P.C., has learned that one of its employees have tested positive for COVID-19. This morning, a member of our firm who works in the Lawrenceville office received confirmation from their medical doctor that they tested positive for COVID- 19. We want to assure you that this individual is in great spirits and recovering at home. This individual has not been in the office since March 16.
The Firm will be contacting employees that it has reason to believe may have come into close contact with the diagnosed employee during the time period when they were most recently in the workplace. However, given the highly contagious nature of COVID-19, we ask that all employees closely monitor their health and reach out to their health care provider to determine appropriate next steps.
The Firm is also taking appropriate measures to ensure the safety of our employees during this outbreak, including keeping most of its workforce separated and at home, as well as regular cleaning and sanitizing of the workplace. Good morning,
As a result of the declared COVID-19 pandemic, many people have been given the directive to work from home. Some of us have been working from home before the pandemic fell upon us, but many of us continue to live in the “work-at-work” world, and working from home is a new concept that takes some getting used to. Rest assured that my team is here to support you during this transition. Below are a few tips from seasoned work-at-home veterans.
1. Get Dressed
While it is tempting to “work in wake in”, you will be more productive if you show up for work, even if your commute is only to the next room over. Shower, brush your teeth, and put on some decent clothes as if you were commuting to an office. Aside from the possibility that you will be meeting people via video, showering and dressing are great ways to tell your brain and your body that “today is a work day, even though I’m not in my office.”
2. Stick to Your Routine
If you normally work from 8:30am to 5:00pm, try to stick to the same schedule. When you are working from home, you should strive to live by the same rules that apply to you in an office setting. You would not leave work to go for groceries in the middle of the day, so you must not treat working at home as a working vacation or a busy weekend.
3. Create a Dedicated Workspace
Find a place in your home where you can minimize distractions and focus on your work. Try to avoid setting up camp in a high traffic area such as your kitchen. Clear your workspace from household clutter as much as possible. However, do not stress if your only option is to work in your kitchen and you are forced to work around the daily clutter of life.
4. Minimize Distractions
The most difficult aspect of working from home is maintaining focus, especially in times of anxiety and change. Everything seems to call out for attention- your laundry, your children, your pets, your partner, your personal cell phone, social media, news, and household life. Work requires undivided attention, so try focusing on doing one thing at a time, and doing it well.
5. Accept the Noises of Your Home
In the last few days, you may have been on a phone call with your colleagues only to hear a dog barking (possibly your own), a child demanding attention (possibly your own), or a spouse or partner yelling from another part of the house, “Honey, where’s the toilet paper?” The noises of a home are natural, normal, and often quite funny. Clearly, if you are on a large conference call, you should mute your phone unless you are speaking, but on a small group call, these interruptions will be welcomed and understood by your teammates, sometimes even eliciting some much-welcome humor. When your child is demanding your attention, bring them into the phone call briefly (if you can) and introduce them to the group.
6. Connect With Your Colleagues One-on-One
Many of us may feel a little lost, lonely, and anxious after days (or hours) of social distancing. It is important to build in time in your day for a phone call or video app conversation with a co-worker each day. Find ways to brighten someone else’s day with humor and caring.
7. Manage Your Time
Use your calendar to schedule meetings and block out time for work that requires concentration. Use “time boxing” techniques to assign time on your calendar for important tasks. Schedule time between projects to check on email and texts. Try to stick to your plan as much as possible.
8. Don’t Be Too Hard on Yourself
Social isolation during the COVID-19 crisis can be difficult. If you are feeling lonely or anxious, talk to someone. It is important to practice good nutrition and to get plenty of exercise. Maintaining your health and staying connected to others will help improve your mindset and stay positive!
9. Don’t Be Too Hard on Others
See above! Remind yourself to take deep breaths, and remind others to do the same. Check in with your family, co-workers, neighbors, and friends. In times like these, we need to stay positive and support each other.
10. Take the Time to Reflect and Be Grateful
In times of crisis and change, it often helps to spend some time to reflect. Give yourself (and others) the time and the space to consider all that you have to be grateful for. We are all experiencing fear, pressure, and anxiety. But, we all have families, friends, co-workers, and communities around us who are here for us. Don’t forget that. And don’t forget to reach out a helping hand when you can.
11. Be Mindful Of Your Media Consumption
As helpful as the news can be in encouraging precautions and keeping everyone informed, the rules regarding “too much of a good thing” apply here. With all of the ambiguity surrounding this crisis, people are looking for answers in a varied number of places. Do your best to rely on reputable sources when looking for answers and be careful with what you consume on social media. The goal should be to increase your awareness and stay informed, but not to panic and increase your anxiety.
12. Don’t Be Afraid to Ask for Help
Going back to the last point, it is easy to get overwhelmed by the amount of information out there, being home with your children/family or in isolation, and still operating in a normal work capacity. Trying to manage everything can be daunting, but you should take your temperature every now and then, metaphorically speaking, and ask for the help you need when you need it. There is nothing abnormal about what you are feeling, but nobody can step in to help you through it if you don’t reach out. Please see the below updates regarding the current state of affairs at Stark & Stark.
Yardley Office is Closed
In compliance with Gov. Wolf’s most recent order, we have made the decision to close our Yardley office until it is deemed safe for us to return. USPS mail is being picked up by a courier at the Yardley Post Office, and is being processed in Lawrenceville. All Yardley employees are instructed to ask for any overnight deliveries to be sent to our Lawrenceville address (993 Lenox Drive, Building 2, Lawrenceville, NJ 08648). Phones in Yardley are being answered in Lawrenceville.
The Yardley building management is planning to secure the building, so you will only be able to get access to the building with your key fob. If you have an emergent need to access the office, please contact Michael Donahue or me. So you know, the Yardley building is continuing their daily janitorial services during this building closure.
Protocol for Coming to NJ Offices
To be consistent with Governor Murphy’s order on Saturday, March 21, no one is permitted to come to any NJ office without being pre-authorized by Michael Donahue. If you have a need to be in the office, you must communicate that need to Michael and me. Based on your need, we will coordinate a time with you and ensure that you have a letter that you can share with an authority (such as a police officer) if necessary.
More specifically, anyone who comes to the office, including those who are currently coming to the office every day, must wash their hands upon entry into our office for at least 20 seconds with soap and water, and must do the same upon their departure.
Office Sanitization
The Lawrenceville office will be sanitized between Tuesday and Thursday of this week. What “sanitize” means in an office environment is that all nonporous surfaces (desktops, windowsills, tables, armrests, telephone handsets, etc.) will be sprayed with a disinfectant spray and wiped for a prescribed period of time. No papers will be moved for this process, so cluttered desks will be left alone. Nonporous surfaces (such as fabric chairs) will not be cleaned, and no computer equipment will be cleaned either.
The Firm is taking this step to proactively ensure that our offices are clean. We expect to announce a schedule for sanitizing Yardley and Marlton in the next few days.
Tips for Working from Home
Our Marketing and Human Resources departments have compiled some guidance for being successful while working from home. We will be sending them out tomorrow morning for your review. Yesterday, Governor Murphy announced a “Stay at Home” order for all New Jersey residents. His announcement comes on the heels of a similar announcement from Governor Wolf.
Lawrenceville and Marlton Offices
Governor Murphy’s order makes it clear that it is acceptable to have a small group of employees onsite to do the work that must be done onsite.
Last week we identified specific individuals to perform essential Firm functions in Lawrenceville and Marlton. We currently expect they will continue to work in their respective offices as we continue to function through this disruptive time. Firm leadership will always be onsite to assure our continued successful operation.
Yardley Office
Governor Wolf’s order is not as clear. For Monday, March 23, the Yardley office will be closed. Regular mail (USPS) will be picked up at the Yardley post office and delivered to Lawrenceville for scanning.
Yardley leadership is meeting on Monday morning to determine the best way to proceed, and we will let everyone know more then.
Keeping Clean
We want you to know that building services are continuing to keep the offices clean. In Lawrenceville, we still have an extra crew coming through the office to wipe down surfaces and do extra cleaning throughout.
Social Distancing
Whether you are working in the office or working remotely, please follow the orders that our governments have published. In particular, they ask us to practice social distancing. Stay at home as much as possible, and don’t congregate with groups of people.
Remote work extended indefinitely
For everyone else, we are asking you to continue to work remotely. We had indicated in a prior message that we expected everyone to return to work on Monday, March 30. We are extending our “work remote” directive indefinitely, and we will be sure to keep everyone in the loop as we learn more from our government authorities.

Unfortunately bad actors are leveraging the current Coronavirus epidemic for malicious intent. It has escalated so quickly that the United States Secret Service issued a press release.
As you might imagine, the phishing attacks exploit our concerns regarding COVID-19.
One widespread campaign includes a poisoned PDF document labelled “CoronaVirusSafetyMeasures_pdf“ which, if opened, can give full administrative control of your computer to the attacker.
Another uses a three-page coronavirus-themed Microsoft Office document purported to be from the Center for Disease Control to drop a backdoor onto a victim’s computer. The fake message includes calls to urgency; “the coronavirus has “officially become airborne” and there “have been confirmed cases of the disease in your location.””
Accordingly, it is critical that you follow good email practices. If you have the slightest doubt about an email, DO NOT OPEN IT. Instead, please contact the help desk for instructions.
Another area of concern is malicious COVID-19 websites.
Check Point Threat Intelligence has identified over 300 websites that are malicious/suspicious.
Corona virus maps are being used to compromise systems.
Accordingly, we recommend that you only visit well known sites (e.g., CDC.gov, nytimes.com, etc.) for your corona virus news.
Working from home also potentially increases your exposure to “vishing” attacks.
Beware calls from Microsoft or your Internet Service Provider that indicate that there is a problem with your connection (e.g., poor quality, your machine is sending malicious data, etc.). Their intent is to gather information about you and your systems with the ultimate goal of getting you to allow them to connect to your machine remotely to “troubleshoot” the issue.
Accordingly, do not give out information to any party calling without positively identifying them. The best approach is to call them back at a number you find listed on that companies website.
Please report any phishing or vishing attacks immediately to the help desk. Stay healthy & safe, both physically & digitally.

Scanning of Mail
MCS successfully scanned in all of today’s mail, and I am assured that it has been placed in your respective workspaces in NetDocuments. Today was a learning day for the MCS team, and I am confident that the scanning process will continue to get faster over the next few days:
- Take a close look at the quality of the scans. If you find any issues or concerns, please email facilities@stark-stark.com and they will work to ensure that quality issues are addressed.
- Don’t forget to check your incoming mail workspace. You will not receive notification that mail has arrived, so you should check at least twice daily.
Working Remotely
Regarding working remotely, the IT department has been working at a furious pace to get everyone set up. As of the end of the day today, 75% of the firm is working remotely, and they hope to get everyone else set up between Thursday and Friday. We have heard reports of intermittent connectivity issues for the remote desktops as well as some challenges using the Avaya Soft Phone. Rest assured that IT is working very hard to address all of these issues. Please note that in this time of incredible pressure on the IT department, they are prioritizing all requests:
- Getting remote desktops set up is the highest priority
- Getting soft phones set up is the second priority
- All other issues are addressed as quickly as they can be based on the severity of the issue.
Checking Voice Mail Messages
Some of you do not yet have access to your remote desktop, and you also do not have the Avaya Soft Phone. Please see these instructions on how you can check your voice mail using any outside phone. If you do not know your passcode, the Help Desk can help you reset it.
COVID-19 Legal Resources Web Page

Our offices in Lawrenceville and Marlton remain fully staffed on Tuesday, March 17, 2020.
Here a few things to keep in mind:
- We are moving to remote work because we believe that we can heed the responsible call to engage in “social distancing,” while remaining committed to serving our clients and our community. We are unaware of any diagnoses, symptoms, or exposures in our offices to COVID-19.
- For those of you who are working remotely, you are expected to be available during business hours (8:30 a.m. – 5:00 p.m.).
- A team of identified “essential staff” will remain onsite at our offices. This includes Office Services (MCS), IT, Finance, Floaters and Switchboard, as well as Firm leadership. Essential staff will be onsite at their respective locations between 8:30 a.m. and 5:00 p.m.:
- Lawrenceville
- IT will continue to work to get everyone supported and set up with remote work tools.
- Finance will continue to make deposits and cut checks as necessary. Steve Townsend will be following up with everyone regarding any changes in procedure.
- MCS will handle mail, scanning of mail, and other projects as necessary.
- Floaters will be available to assist with emergent issues as they may arise. Keep in mind that the floaters are a limited resource, so “emergent” needs to mean exactly that.
- Firm leadership will be available onsite to address questions and issues as they arise.
- Marlton
- The Marlton office has identified essential staff as Tracy Roehr and Clare Mickle-Ciconte.
- Yardley
- The Yardley office has identified essential staff as Judy Hess and Sue Hagan.
- Lawrenceville
- Starting on Wednesday, March 18, MCS will begin scanning all incoming mail to each group. This is described in detail below.
- Each of your groups should have daily check-in meetings with each other that will be organized by your team leaders.
This is an evolving situation, and we will keep you in the loop as we learn: We will learn how well our newly instituted procedures work, and we’ll modify them as necessary. We will also learn more about the situation out in the world, and we’ll keep you informed as we learn more.
Incoming Mail
All incoming mail will be scanned by our office services team and delivered to a NetDocuments workspace named by your team (see below).
This means that every piece of mail that is sent to our office will be opened by MCS (and scanned) according to the following rules:
- Mail labeled Personal & Confidential will be opened, scanned and sent via email to the designated recipient ONLY.
- All checks will be sent to the Finance department directly, and Finance will ensure that each group receives the information they need to handle settlement checks or to determine how to allocate a payment. Any scanning of checks will be done by our Finance Department – not MCS.
- Clearly identifiable junk and/or bulk mail will not be scanned, such as magazines, advertisements, etc.
- Large and large format documents, films, and other odd media: Cover letters will be scanned along with an attachment from MCS indicating the size and content that can be retrieved from MCS (see below).
- CDs, DVDs, and thumb drives. Cover letters will be scanned and the digital media will be given to IT to load onto the network for your group’s use.
- FedEx and other priority mail will be scanned before all regular mail.
- All other mail will be scanned and placed into the appropriate NetDocuments workspace. Unknown mail will be placed in the unknown mail workspace for handling by our receptionists who will be onsite.
Mail that has been handled (above) will be placed into mail bins for each team; however, they will not be delivering paper mail to group’s desks. It will be organized securely so that your team can pick mail up at times that you will deem appropriate. When you want to pick up your group’s physical mail, please reach out directly to Facilities, and they will coordinate with you.

Outgoing Mail
All outgoing mail must be placed in an outgoing mail bin with the 3rd floor reception in Lawrenceville. MCS will process this mail at 3:30 p.m. every day. Marlton and Yardley will be handing outgoing mail per their own internal procedures. If you have any urgent needs, send an email to facilities@stark-stark.com, or call them at x7259.
We All Recognize That This Is a Stressful Time
We recognize this is a stressful time for everyone. We are all dealing with the fear associated with the developing virus situation, and we are all dealing with the stresses of our changing work situation.
Whenever you feel overwhelmed, remember that it is OK to feel overwhelmed, and it is OK to share that feeling with others. You should also take time throughout the day, especially since you’re home, to stop for a few minutes, take a deep breath of fresh air in your yard, hug your loved one or even your pet. Employees with Stark & Stark Medical Insurance
Aetna will waive all fees for diagnostic testing related to COVID-19. This policy will cover the test kit for patients who meet CDC guidelines for testing, which can be done in any approved laboratory location. The member costs associated with diagnostic testing at any authorized location will be waived.
What to do if you are sick with any illness: Aetna members should use telemedicine as their first line of defense in order to limit potential exposure in physician offices. Cost sharing will be waived for all video visits through the CVS MinuteClinic app, Aetna-covered Teladoc offerings and in-network providers delivering synchronous virtual care (live video-conferencing). For members choosing to use Teladoc’s services, $0 Teladoc visits can be requested through “normal” channels such as the existing mobile Teladoc app, or by calling 1-800-Teladoc.
Informed Health Line: Aetna’s FREE 24/7 nurse advice line is prepared to field calls and answer questions for members on the coronavirus. They will continue to update guidelines to properly recommend when a member should seek ER care vs an office visit with their PCP. There is no cost for this service. You can speak with a nurse any time of day, 7 days a week, by calling 800-556-1555. The Informed Health Line is now open to ALL Aetna members – including those who are only dental or vision customers (normally only offered to medical members only).
Crisis Response Lines: Available to all Aetna members who may be experiencing anxiety related to COVID-19. Please call 833-327-AETNA / 833-327-2386 to speak with an experienced representative.
Early refill limits on 30-day prescription maintenance medications: Aetna will waive early refill limits for all members with pharmacy benefits administered through CVS Caremark. CVS Pharmacy will also waive charges for home delivery of prescription medications. Aetna strongly recommends that plan members who have long-term maintenance medications to refill eligible maintenance prescriptions for 90-day supplies, or up to the plan’s maximum quantity.

Your health and well-being and your family’s health and well-being are our top concern. To protect your health while we serve our clients, the Firm has recently approved and activated a Pandemic and Infectious Illness Policy, which is available at the below link:
Pandemic and Infectious Illness Policy
In short, we have set into motion certain practices and guidelines for everyone to following during this pandemic. Please read the policy in its entirety, as it contains important details, but below is a short summary:
- If you have been diagnosed, have symptoms, or have been exposed to someone who has been diagnosed, you must let us know, and you will be required to go home. If you have been exposed to someone who demonstrates symptoms, please let Human Resources, Greg Deatz, or Michael Donahue know as soon as you can.
- If you are affected by COVID-19, you will not lose PTO or vacation time, particularly if you are directed to stay at home or if the Firm is required to institute a partial or full office closure. Further, under most circumstances, you will be kept whole with respect to pay.
- We will be making it possible for those who are affected by COVID-19 to work from home, on a “business need” basis.
- We are asking you to exercise extremely good judgment when it comes to travel of any kind. Clearly, we do not want you taking cruises or trips to areas of high risk such as China, Iran, Italy, or South Korea. However, we also want you to exercise good judgment when it comes to any kind of travel, particularly when the travel includes gatherings of any significant size.
- Please talk to your supervisors openly and frequently about any planned time off that you might have. It may become necessary for you to delay or cancel planned vacations or time off.
- Please let me know about your travel plans (both personal and professional). The Firm needs to know where you are planning to go to, and we may need to ask you to delay or cancel your plans.
- We are asking you to practice good hygiene, washing your hands frequently and using hand sanitizer as necessary.
There are several directives in this policy. For example, we are prohibiting guests from being in our offices if they have symptoms, have been exposed, or have been diagnosed. I would caution everyone, though, to first read this policy, and then wait for more direction from their supervisors on how various components will be implemented.
Finally, we understand that this policy does not answer all questions and may prompt others. Please direct any questions you may have to your practice group leader, Greg Deatz, or Michael Donahue. We are working to communicate with all of our practice areas, teams, and departments to create the necessary action and/or contingency plans. We ask for your cooperation and patience as we all work together.

As I am sure most of you are aware, the World Health Organization characterized the spread of COVID-19 as a pandemic. We know you are concerned about the Coronavirus (COVID-19) and we want you to know that your health and safety is our top priority. We will work together and devote our resources to keeping each other and our families healthy while we continue to deliver the highest level of service to our clients.
Already, we have put some action into place:
- Our janitorial staff is now cleaning our bathrooms twice per day, and they have been directed to focus twice daily attention on commonly touched surfaces such as door handles, bannisters, etc.
- We have ordered extra supplies of hand sanitizer and wipes to be available to everyone.
- We have prepared a website that will contain all of our past and current communications regarding this health crisis (https://www.stark-stark.com/legalstark/stark-stark-employee-alert/), and the password to view it is “employeehealth2020”.
- We are preparing communication and guidance for you, and we plan to communicate all future alerts not only through email, but also through our cell phone alert system, to be sure that everyone is receiving our alerts.

Right now, one of the best things that all of us can do is to practice hygiene as the CDC has advised:
- Wash your hands frequently, and, in particular, after using the restroom. CDC guidance suggests that you should wash your hands with soap and water for at least 20 seconds.
- As needed, clean your hands frequently with hand sanitizer.
- Avoid touching your mouth, nose, and eyes as much as possible.
- When you cough or sneeze, follow the coughing & sneezing etiquette provided by the CDC, which, in summary, advises you to:
- Cover your mouth and nose with a tissue when you cough or sneeze, and throw the tissue away.
- If a tissue is not available, cough or sneeze into your upper sleeve, NOT your hands.
- Immediately wash and/or disinfect your hands.

This year has been a difficult flu season all around, and it is important to recognize that even while the coronavirus is not an immediate health crisis in our region, respiratory illnesses such as the flu remain serious health concerns. The Developing Situation
We are actively monitoring the news, and we plan to follow any guidance that comes from the State of New Jersey, the State of Pennsylvania, the federal government, and the Centers for Disease Control and Prevention (CDC).
As the situation develops and as any need arises to develop new policies or procedures, we will communicate with you as quickly as we can.

Guidelines for Respiratory Etiquette and Hand Hygiene
Over the course of the next few days, you will notice that hand-sanitizer, and cleaning products such as antibacterial wipes, etc. will be made readily available in conference rooms and on request to those who ask for them. You will also notice some reminder posters that will be posted in our restrooms and in our public spaces that address the following items of respiratory etiquette and hand hygiene:
- Wash your hands frequently, and, in particular, after using the restroom. CDC guidance suggests that you should wash your hands with soap and water for at least 20 seconds.

Upon your return, if your travel destination is considered an area of concern by the CDC, you will need to speak to a member of the Management Team before you return to work.
Firm Policies Regarding Staying at Home While Sick or Caring for a Sick Family Member
The Firm has adopted the following policies regarding staying at home while sick and caring for a sick family member. They will be in the next release of the Firm’s handbook.
Staying Home While Sick
In an effort to keep everyone at the office healthy, employees who are sick should stay home while they are recovering.
More specifically, employees who have symptoms of acute respiratory illness (cough, shortness of breath, sore throat, body aches, fever, etc.) or a fever of 100.4° F (37.8° C) or greater using an oral thermometer are directed to stay at home. They may return to work when they are free of fever, signs of fever, and other acute respiratory illness symptoms for at least 24 hours.
If an employee comes to work with symptoms of acute respiratory illness, s/he will be directed to go home.
The Firm’s time off and/or leaves of absence policies apply to any time taken for time away from the office while sick. Employees may use any available PTO for absence due to illness. If an employee would prefer not to use PTO, the time off will be unpaid, unless otherwise required in order to comply with applicable law. Employees should notify their supervisor(s) when they are staying home while sick.
Bringing Sick Family Members to Work
The Firm recognizes that employees may have daycare or other caregiving issues when their family members are home sick; however, in the interest of keeping the Firm’s workforce healthy, employees are prohibited from bringing their sick family member to work.
The Firm’s time off and/or leaves of absence policies apply to any time taken for time away from the office while caring for a sick family member. Employees may use any available PTO for absence due to a family member’s illness. If an employee would prefer not to use PTO, the time off will be unpaid, unless otherwise required in order to comply with applicable law. Employees should notify their supervisor(s) and department when they are staying home to care for a sick family member.
